New on Sports Illustrated: Seton Hall's Myles Powell Suffers Concussion, Out Against Maryland


Myles Powell hit his head on the hardwood after taking a charge in Seton Hall's game against Rutgers.

Seton Hall guard Myles Powell suffered a "pretty bad" concussion in the Pirates' loss to Rutgers on Saturday and will remain sidelined for the team's game against No. 4 Maryland on Thursday, coach Kevin Willard announced.

Powell sustained the injury after taking a charge and hitting his head on the hardwood. After he got up, Powell ran into teammate Tyrese Samuel. 

"He asked me during the game, 'Why are we practicing at Rutgers?,'" Willard said on AM970. "We sat down and his eyes kind of rolled into the back of his head, it just hit him with a wave."

Willard added that Powell was starting to "come through" after the game ended.

Due to the NCAA concussion protocol, Powell will not be ready in time to face Maryland on Thursday. He will be evaluated in three days, Willard said, where his status can be further determined. 

"We'll see what happens after Maryland," Willard said.

Seton Hall, 6-4, had already lost its second-leading scorer heading into Saturday, as forward Sandro Mamukelashvili remained sidelined with a fractured wrist suffered on Dec. 8 against Iowa State. 

An All-American candidate and Seton Hall's leading scorer, Powell stands at sixth in the nation in scoring with 22.9 points per game. He also sprained his ankle earlier this season but did not miss significant time.

Ohio State's Chase Young said he was caught "off-guard" on Friday night when TMZ Sports asked him about his NFL draft plans, to which he responded that returning to school was "the plan."

Asked about his comments on Saturday, ahead of the Heisman Trophy presentation, Young said he has no "plan."

"I'm not even really worried anything in the future, I'm just worried about just beating Clemson right now," he said.

Young, a junior, leads the nation in sacks (16.5) and has 44 tackles, 21 for loss and seven forced fumbles this season. Earlier this week, he won the Chuck Bednarik Award given to the nation's top defensive player. He was suspended for two games in November for violating NCAA rules but returned to set a new Ohio State single-season record for sacks against Penn State.

The potential No. 1 pick in this year's draft and his teammate Justin Fields are among the group of Heisman finalists along with LSU quarterback Joe Burrow and Oklahoma QB Jalen Hurts. If Young enters the draft, Burrow could be his greatest threat to being selected No. 1 overall.

Clemson spurs into Early Signing Period week with fresh offer, commitment of elite linebacker prospect Trenton Simpson.

Entering Saturday, Charlotte (N.C.) Mallard Creek senior Trenton Simpson was set to start his role as one of Clemson’s esteemed official visitors. Prior to this visit, Simpson had not yet been verbally offered by the perennial playoff power.

After a few hours, the senior linebacker projection not only got the good news he’d been curious about, but Simpson also provided some good news for Dabo Swinney and company, in kind. And just days away from the Early Signing Period, where he can make the decision official, he committed.

Simpson announced the news via Twitter just hours after announcing the Clemson scholarship offer that seemingly eluded him as a prospect. The one-time Auburn commitment was considering several programs down the stretch and desired to get to a decision before the week’s outset. 

Just days earlier, he told Sports Illustrated he had yet to settle on one school or even a small group of finalists heading into the weekend. Simpson said the last visit, in addition to in-home visits from potential coaches, would settle his recruitment.

SI Scouting Report: 

Most 6-foot-3, 225-pound linebackers with length and three-down ability are the types you see selected very early each NFL Draft, and Simpson fits the profile both on and off the field. He’s got great length and raw athleticism, but has an all-around game that makes him look like a veteran at an early stage.

Coming up as a running back, Simpson seamlessly transitioned to linebacker in high school because of his vision and striking ability on the field. It means he’s very suited to play inside linebacker in college, but even more intrigue exists on the outside. Good length and a feel for coming off the edge—which led to 20-plus sacks in 2019 as an occasional rusher—makes Simpson an ideal three-down candidate. Not only can Simpson rush the passer, he can also play the run and cover to boot; exhibiting the ideal traits that this position calls for in this day and age.

In terms of overall athleticism and play-making ability, Simpson additionally put in over 1,000 yards running the ball as a senior for Mallard Creek, one of the top preparatory programs in the country. 

Clemson’s 2020 Class

While there are still some top prospects set to announce between now and the end of the Early Signing Period this week, it will be tough for programs to match Clemson’s overall star power in the end. The group has compiled what is to be expected this era under Swinney, a top class with superstars paired up with one another.

The defensive line group is led by a trio that is all in competition with each other for No. 1 in any individual ranking in Bryan Bresee, Demonte Capehart and Myles Murphy with the compact and disruptive Tre Williams to boot. Simpson rounds out a linebacker corps that may end up as the best in America should it add Justin Flowe, but already sits elite with Kevin Swint and Sergio Allen on board. The offensive line group is expansive with a half-dozen prospects while running backs Demarkcus Bowman and Kobe Pryor could contend for top duo in the country.

Of course top quarterback prospect D.J. Uiagalelei is where most would kick off the Tiger recruiting talk, but this class is that good. The Bellflower (Calif.) St. John Bosco star goes for the perfect end to his senior season later Saturday night in a state championship tilt with Concord (Calif.) De La Salle.

New on Sports Illustrated: Newtown High School Wins State Title on Sandy Hook Anniversary


Seven years to the day of the Sandy Hook shooting, Newtown High School won its first state title since 1992.

Seven years to the day of the fatal shooting at Sandy Hill Elementary, an event in which 20 first graders and six adults were killed in a spray of gunfire, the Newtown High School football team made history.

With just 3.3 seconds remaining in the Class LL state title game Saturday afternoon, Newtown Nighthawks quarterback Jack Street connected with Riley Ward for a 36-yard game-winning touchdown, as the school took home its first state title since 1992.

The 13-7 win over Darien High School capped off an undefeated 13-0 season for top-seed Newtown. 

The game reportedly began with a moment of silence in remembrance of the shooting victims. 

It ended with a euphoric triumph.

Navy QB Malcolm Perry rushed for more than 300 yards on Saturday as the Midshipmen blew out their rivals 31-7.

Players from both Army and Navy will tell you that wins and losses in the famed rivalry don’t come down to one man. But in the 120th meeting between the service academies, it would be hard not to give senior quarterback Malcolm Perry a particular badge of honor. 

The QB from Clarksville, Tennessee didn’t throw a single pass on Saturday afternoon, but in the eventual 31–7 blowout, Perry’s play proved to be too dynamic for any opposing player to stop. 

He carved up the Army defense on the ground, finding countless holes through a plethora of offensive wrinkles. The Midshipmen’s triple-option attack pounded the Black Knights, as Perry himself ran for 304 yards—the most ever by any player in the series’ history—and two touchdowns.

The Black Knights scored first on Saturday afternoon, but other than a 78-yard first quarter drive, they failed to move the ball with any consistency and were blanked throughout the final three quarters.

Heading into the season Navy coach Ken Niumatalolo had to reassure Perry that he wanted the senior to be his quarterback.

“We’re putting all our chips on you,” the coach said prior to the year. And on Saturday afternoon, the QB delivered, gouging the Navy defense no matter how many defenders followed.

In all, the Midshipmen ran for nearly 400 yards and their lone pass—an homage to the Eagles’ “Philly Special”—accounted for one of the team’s four touchdowns. 

Navy had lost its last three appearances in the famed rivalry—a fact Perry acknowledged following his stellar performance. 

This time, the senior made sure that the Midshipmen would leave Philadelphia having won 10 games for the first time since 2015, picking up a victory over their rivals in the process.

"If I could win one," Perry told the CBS' Jamie Erdahl after the game, "this is the one I  wanted to win."

“I think the world is sensitive to the issue regarding marijuana,” Jones said on 105.3 The Fan (KRLD-FM). “It’s also an issue contemporarily where we’re excited about being in step with the social and legal scene as it goes forward. And so, we not only have the interest of competitiveness in mind when it comes to any type of substance. We have the issue of the law, and we have the issue of the society focus on it."

Marijuana is currently a banned substance in the NFL, and repeated usage can lead to indefinite suspensions. However, it is fully legal in 11 states and a number of others have legalized medical marijuana.

"All of that cause and does receive attention when you’re discussing this area with players, and I think that you should expect and will expect an adjustment of the contemporary way or the present way that marijuana is being thought about," Jones added.

On Thursday, as part of changes in a new joint drug agreement between MLB and the players’ association, MLB announced that marijuana will be removed from the list of "drugs of abuse" and will be treated the same as alcohol.

Jones was speaking following the NFL's winter meetings, which were held in Dallas this week. 

While on Friday the Cowboys' owner didn't comment on how talks with the NFLPA have progressed, it has previously been reported that the league is also looking to add another regular-season game, potentially by reducing the preseason. 

The 10-year CBA agreement between the league and the union runs through the 2020 season, and the two parties have been negotiating to try and avoid a work stoppage.

Quarterbacks

Jameis Winston, Tampa Bay Buccaneers

If you think, like I do, that the Bucs have an interest in getting Winston to 5,000-plus passing yards this season, he will need to average about 295 yards per game to accomplish that goal. So long as his thumb holds up, I think Winston not only gets those passing yards, I think he adds two or three passing touchdowns as well.

Ryan Tannehill, Tennessee Titans

Tannehill continues to defy expectations and has put up terrific fantasy numbers all season. Las Vegas has this week’s over/under against Houston at 50 implied points, which is the highest point total of the week. Considering the Texans will be keyed in on stopping Titans RB Derrick Henry, look for Tannehill to have another huge week throwing the football. I also like how his rapport has improved with first-round draft pick WR A.J. Brown.

Deshaun Watson, Houston Texans

Watson is a great quarterback, but he becomes even greater when he has time to pass—and when WR Will Fuller is in the lineup. Both things are expected to happen in Week 15. The Titans' pass rush is good, but not good enough to force Watson to throw earlier than he wishes, plus Fuller is expected back from a hamstring injury. Look for Watson to have a huge week.

Philip Rivers, Los Angeles Chargers

For weeks, we have seen that the Vikings' defense is stout against the run, but soft against the pass. This should play right into the hands of Philip Rivers. Rivers has many mismatches on the field including RB Austin Ekeler out of the backfield, WR Keen Allen in the slot, and WR Mike Williams on the outside. I can see all three players making a significant impact on this game's outcome.

Running Backs

Chris Carson, Seattle Seahawks

What do you get when you put a running back on a team which likes to run 25-to-30 times a game against the worst run defense in the league? You get a lock-and-load start in seasonal and DFS formats! Carson might be the chalkiest play of Week 15, but he also should be the best play. The Seahawks want to run the ball often, and with Rashaad Penny’s injury, Carson will get all the carries he can handle. Start him with full confidence on Sunday.

Patrick Laird, Miami Dolphins 

Laird has emerged as a late-season threat, particularly in PPR formats. In Week 15, look for Laird to once again get 15-to-20 touches, which could be way more valuable this week against the soft Giants' defense than it was against the Jets' second-ranked run defense. Laird is what I like to call a sneaky start—and one who might pay huge dividends to fantasy owners.

Raheem Mostert, San Francisco 49ers

Mostert has picked up his play in recent games and has impressed the coaching staff so much that they admitted that he is the team’s new lead back. What makes Mostert special is that he not only has great power out of the backfield, he also catches the ball fluidly, and is big enough to stay on the field in short yardage situations. Mostert is not likely to get 20-plus touches in the 49ers' running back by committee offense, but I think he should be able to get 15 touches, which should still help his fantasy owners.

DeAndre Washington, Oakland Raiders

I am basing this selection on the thought that the Raiders will shut down starting RB Josh Jacobs with a shoulder injury. Jacobs was inactive in Week 14, and with the Raiders out of the playoff hunt, it makes little sense to risk their star player in a meaningless game. Washington should get the opportunity to be the early-down running back against a Jaguars defense which has obviously quit on the coach. Washington will split carries with Jalen Richard, but if there is a TD to be scored, Washington will have the best chance to score it.

Wide Receivers

DeAndre Hopkins, Houston Texans

The Titans are without starting CBs Malcolm Butler and Adoree Jackson in what has become a must-win game for both teams. Deshaun Watson should have time to throw, which only makes Hopkins more deadly in the passing game. Look for him to have eight or nine catches for 100-plus receiving yards and a TD. You drafted Hopkins as the first or second overall wide receiver back in August for games like this—hopefully it pays off!

Jarvis Landry, Cleveland Browns

Landry has been getting the lion’s share of the targets from Mayfield over the past month (more than 30%), and the Cardinals are one of the worst team at covering slot receivers in the league. Landry should be well on his way to another fantastic game in Week 15.

Danny Amendola, Detroit Lions

Sometimes it pays to be contrarian and this week, Amendola is a great contrarian play. Most people will gravitate towards playing WR Kenny Golladay, but the Bucs will most likely double cover him, which should leave room for Amendola to navigate the middle of the field. With Marvin Jones on injured reserve, Amendola is the best weapon the Lions have to consistently move the chains.

Michael Gallup, Dallas Cowboys

Amari Cooper is going to draw Rams CB Jalen Ramsey in shadow coverage this week, leaving Gallup as Dak Prescott's main target in the passing game. Gallup has shown that he can handle the workload (he has two 100-plus yard receiving games in the past month) and he has terrific hands. Even better is that Gallup has failed to score a TD in the last four games, which makes him due to find the end zone if you believe in positive regression.

Tight Ends

George Kittle, San Francisco 49ers

Kittle is a target-share monster (24%) who plays on practically every offensive snap. He is Jimmy G’s go-to guy, and he should be able to find plenty of room to operate against the Falcons this week.

David Njoku, Cleveland Browns 

This week, the Cardinals (who are still the worst team in the league at covering opposing tight ends) play the Browns, which means that Njoku is in play. Njoku has always been a good red zone player and it seems likely that he will find pay dirt this week.

Darren Waller, Oakland Raiders

With Tyrell Williams dealing with a heel injury, and Hunter Renfroe still not healthy either, the Raiders have been featuring Waller for the past month. He has 21 catches on 28 targets in that time and has become Derek Carr’s first option in the passing game. The Jaguars' defense has looked like it has given up as of late, so I think that Waller is in a great position to make a few plays and find the end zone at least once.

Ian Thomas, Carolina Panthers

I have a feeling that the Seahawks' lack of success in covering the tight end has been overlooked, but that is something that fantasy owners can take advantage of this week. Rams TE Tyler Higbee had seven catches for 116 yards against Seattle, and I am hoping that Ian Thomas follows suit with a similar week. With the Panthers' season winding down and the team failing to make the playoffs, Thomas should get every opportunity to show that he can take over for Greg Olsen and be next season’s starter.

The Dolphins rewarded WR DeVante Parker with a four-year extension on Friday.

Despite the Miami Dolphins' season-long struggles, wide receiver DeVante Parker has emerged as one of the team's biggest bright spots. 

On Friday, the No. 14 pick in the 2015 NFL draft was rewarded for his stellar play, as the team announced a four-year extension with the WR, keeping him in Miami through 2023. 

According to NFL Network's Ian Rapoport, the deal is for $40 million, including $21.5 million in guarantees and an $8 million signing bonus. 

"It’s always been my desire to keep DeVante as a member of the Dolphins family," his agent Jerry Gould told Rapoport.

This season, Parker has totaled career-highs in receiving yards (882) and touchdowns (six).

The move to lock-up Parker on a long-term extension comes after he signed a two-year deal with a team-option this past offseason—2018 marked one of the worst seasons in his young career.

Parker was forced to leave last week's loss to the Jets with a concussion, though it still seems possible that the former first-rounder will play this week at the New York Giants.   

He has yet to miss a game this season.

Former Bruins goalie Tim Thomas said Thursday that his post-concussion syndrome symptoms were so severe that he couldn’t make basic decisions.

WASHINGTON — Former NHL goaltender Tim Thomas said Thursday that his post-concussion syndrome symptoms were so severe that he couldn’t make basic decisions and his brain wasn’t functioning well enough to even watch hockey.

In his first public appearance since walking away from the game, Thomas said a scan taken after he retired showed that two-thirds of his brain were getting less than 5% blood flow and the other third was getting less than 50%. The 45-year-old said it took significant time and help to even be able to communicate with former teammates and others.

He’s still not close to normal.

“I wake up every day and basically I have to reorder everything in my mind for the first couple hours of the day and then make a list and try to make some choices to get some stuff done,” Thomas said before being inducted into the U.S. Hockey Hall of Fame.

Thomas won the Stanley Cup in 2011 with the Boston Bruins and was named playoff MVP. He played parts of 10 NHL seasons before retiring in 2014 but said his experiences made him question if it was all worth it.

“It taught me a value for life and a value for my brain that I’ve never had before,” Thomas said. “And I have appreciation for everything that I never had before. I don’t regret anything.”

Long considered reclusive, Thomas said he lived in the woods for a couple of years because he couldn’t handle human interaction. He got a chance to talk to some old teammates at a game Wednesday nights between the Bruins and Washington Capitals.

New on Sports Illustrated: Analyzing the Health Care Fraud Case Against 10 Retired NFL Players


Ten retired NFL players face felony charges for conspiracy, wire fraud and health care fraud. If convicted, they could spend years in federal prison.

In an announcement that will send shockwaves through the ranks of retired NFL players and their families, Assistant U.S Attorney General Brian Benczkowski revealed in a press conference on Thursday that 10 retired NFL players face felony charges for conspiracy, wire fraud and health care fraud. These players are accused of using a collectively bargained health care fund as “their own personal ATM.”

The 10 players are Clinton Portis, Carlos Rogers, Robert McCune, Correll Buckhalter, Tamarick Vanover, John Eubanks, Ceandris Brown, James Butler, Frederick Bennett and Etric Pruitt. Six of them have agreed to self-surrender to federal authorities, while the remaining four refused to surrender and have been arrested instead.

Two other players, retired wide receivers Joe Horn and Reche Caldwell, are also accused and could face charges.

If convicted, each of the charged players faces the possibility of spending decades in federal prison.

No current NFL players are implicated and none is expected to face accusations. As detailed below, the only players who qualify for the allegedly misappropriated benefits are certain types of retired players.

Understanding the pyramid scheme

The accused players allegedly defrauded the Gene Upshaw NFL Player Health Reimbursement Account Plan of $3.4 million between 2017 and 2018. This $800 million plan is a collectively bargained benefit to retired players who qualify. The plan, which was established in 2006, is administered by a seven-member board of representatives appointed by the NFL or NFLPA. Cigna serves as the plan’s benefits administrator.

Funded by the NFL and its teams, the plan permits qualified NFL players to obtain reimbursement for medical expenses and medical equipment. Qualified players are those who, among reaching other benchmarks, played at least three seasons in the NFL. Along with their spouses and dependents, qualified players can use the fund to obtain tax-free reimbursements for out-of-pocket medical care expenses that aren’t covered by insurance. The potential value of the plan to each qualified player (and their families) is up to $350,000. The precise value is complicated by number of seasons played and when they played, but the takeaway is that the plan offers players and their families hundreds of thousands of tax-free dollars for health care expenses.

Reimbursement requests are made through a conventional practice. The player electronically transmits a reimbursement request form, along with supporting documentation. The claim lands at a data center in Lexington, Kentucky. From there the claim is routed to, and reviewed by, Cigna employees who are located in Lackawanna County, Pennsylvania. At that point, Cigna determines whether or not to pay. If the claim is approved, Cigna either mails a check to the retired player or makes the payment to the player through direct deposit.

This reimbursement process is ordinary and not especially complicated. The same could be said of the alleged scheme hatched by the retired players. The players are accused of submitting false claims for such pricy medical equipment as hyperbaric oxygen chambers, cryotherapy machines, ultrasound machines and electromagnetic therapy devices (designed for use on horses). In some instances, the equipment cost more than $50,000. In all instances the equipment wasn’t actually purchased.

To try to deceive Cigna, the players allegedly submitted fabricated documents that were portrayed as corroborating the request. Phony documentation included from health care providers. Such paperwork was manufactured to seem believable. To that point, false signatures of real doctors and the use of what appeared to be official letterhead were among the deceptive measures. If the government’s accusations are true, the players engaged in blatant health care fraud.

Two of the players are accused of taking additional steps to swindle. They are also portrayed as the scheme’s “ringleaders.” McCune, a linebacker who played sparingly for the Washington Redskins and Baltimore Ravens, and Buckhalter, a former running back on the Philadelphia Eagles and the Denver Broncos, allegedly dialed the telephone number provided on the reimbursement form and impersonated conspiring players. They did so to check on the status of the fraudulent claims and encourage payment as soon as possible. This was a risky move since phone calls to health care companies are sometimes recorded.

Like other health care schemes, the design of this one resembled a mafia pyramid. At the top were two ringleaders who directly and through runners recruited other players. They convinced their recruits to provide their Cigna identification numbers, social security numbers, mailing addresses and dates of birth. Such information was crucial to making credible sounding, but completely false claims. Later, when the recruited players received their ill-gotten reimbursement checks, they kick-backed several thousand dollars to the ring leaders. This process played out numerous times between 2017 and 2018. It led to $3.9 million worth of false claims, of which $3.4 million was paid out.

The accused players are portrayed as unwittingly leaving a trail of obvious criminal activity

There was an inherent defect in the players’ scheme: it was done electronically, and thus left a digital trail for FBI agents and federal prosecutors to follow.

The Fraud Section of the Justice Department’s Criminal Division for investigation was tipped off by Cigna after company employees had detected irregularities and anomalies in certain players’ reimbursement requests. As mentioned above, those requests included reimbursement requests for medical devices that cost tens of thousands of dollars to treat horses. They also included documents that, upon inspection, were fraudulent. Cigna’s anti-fraud staff soon realized there was an abnormal pattern and conveyed that point to the Justice Department. Using data analytics and other anti-fraud measures, the FBI exposed the scheme and its masterminds.

The fact that the fraudulent activity crossed state lines—beginning with a reimbursement request filed in a player’s home state, which in turn was transmitted to Kentucky, then onto Pennsylvania and lastly, through a reimbursement check or direct deposit, back to the player’s home state—is important in terms of the Justice Department’s jurisdictional authority. Criminal activity that crosses state lines empowers the federal authorities to take action.

The players face serious charges

The charges against the players are detailed in two indictments filed in the U.S. District Court for the Eastern District of Kentucky. U.S. Attorney Robert Duncan, who presides over federal prosecutions in the Eastern District of Kentucky, will oversee the cases. Charges include conspiracy to commit wire fraud and health care fraud, wire fraud, and health care fraud.

The conspiracy charges refer to agreements between the players to accomplish specific unlawful purposes. Here, the unlawful purposes are wire fraud and health care fraud. Proof of an illegal conspiracy generally requires a showing of knowledge, intent and a shared objective by the conspirators. Prosecutors insist that the conspiracy occurred in a straightforward and easy-to-see manner: there is unambiguous documentation of players submitting false claims for medical equipment that they didn’t purchase and unambiguous documentation of those players funneling a “cut” of reimbursement checks back to the ring leaders. Benczkowski, who supervises more than 600 federal prosecutions in the Justice Department’s Criminal Division, contends the players acted “brazenly.”

In carrying out the scheme, the players defrauded collectively bargained property—namely, funds that could have instead been distributed to legitimate reimbursement requests made by honest players and their families. As the government portrays it, there was nothing accidental or hidden about the players’ activities. They transparently, and intentionally, engaged in fraud. A conviction on federal conspiracy carries a maximum sentence of 20 years in prison.

As to wire fraud, it is a federal crime to use interstate wire communications—such as phone calls, emails, texts or bank transactions that cross state lines—to defraud a victim of its assets, money or property. Here, the players alleged used phone calls, faxes and other communications that crossed state lines and that were designed to procure ill-gotten reimbursements. Wire fraud, like conspiracy, carries a maximum prison sentence of 20 years in prison.

A charge for health care fraud is similarly designed. Health care fraud refers to knowingly or willfully using false pretenses to obtain money or property from a health care benefit program. The players are accused of knowingly submitting false reimbursement requests. If true, the players would be guilty of committing the underlying act. Health care fraud carries a potential penalty of 10 years in prison.

The players face the real prospect of being convicted and sent to prison for years

The players face multiple counts, each of which carries a maximum prison sentence of 10 or 20 years in prison. McCune, who is considered one of the two ringleaders, faces a stunning 19 counts. Obviously, the players—particularly if they lack criminal records—would not be sentenced to many decades or hundreds of years in prison. The “maximum” sentence for a charge is usually reserved for repeat offenders and for those who engaged in exceptionally egregious conduct. Also, the presiding judge could, and probably would, choose to run all or most of the sentences concurrently, rather than consecutively.

Still, the players face the very real prospect of spending a double-digit number of years in federal prison if they go to trial and are convicted. Although every case is different, a few months ago a health care facility owner was sentenced to 20 years in prison and, in a separate case, a hospital administrator was sentenced to 10 years in prison. Both defendants were guilty of federal health care fraud charges. Health care fraud, particularly when coupled with other kinds of fraud, often attracts lengthy sentences. This is because the convicted defendants essentially stole funds used to pay deserving persons.

The prospect of a conviction is also quite real with federal charges. Federal prosecutors obtain convictions at a rate of 85% to 95%. Faced with these daunting odds, about 90% of federal defendants plead guilty as part of plea deals and hope for leniency in sentencing.

Possible legal defense for the players and how plea deals would work

All of the players are innocent until proven guilty, which requires either a player entering a guilty plea or being convicted by jurors who unanimously believe there is guilt beyond a reasonable doubt. At this early stage in the prosecution, we have not yet heard from the players or their attorneys. In the coming weeks and months, those attorneys could offer defenses that cast questions on the government’s portrayals.

For instance, perhaps the players’ attorneys can show that the medical equipment devices at issue were, in fact, purchased or were in the process of being purchased. The attorneys might also insist that most of the players were victims themselves. Perhaps they felt coerced into partaking in a scheme that the ringleaders presented as legitimate and lawful.

The problem with these types of defenses is that there isn’t much gray area between a credible reimbursement request and a fraudulent one. Either medical equipment was purchased through legitimate invoices, prescriptions and letters of medical necessity or that didn’t happen. Also, if there is clear evidence of kickbacks, the players would struggle to persuasively insist that they “didn’t know any better.” Players transmitting portions of health care reimbursements to other players would seem like obvious kickbacks.

Some of the players might gravitate towards negotiating plea deals with prosecutors. In a plea deal, the player would plead guilty to the charges, or to lesser charges. In exchange, prosecutors would recommend that the player receive a relatively favorable sentence. For instance, instead of spending 10 or 12 years in a prison, a defendant who negotiates a plea deal on fraud charges might be sentenced to a year or two behind bars, along with probation and other non-incarceration penalties.

A plea deal would require that the cooperating player provide value to the Justice Department. The player would be compelled to share all email and other records. He must also be willing to implicate, and testify against, other persons, possibly including former teammates who also engaged in fraud.

To that point, George Piro, the Special Agent in Charge of FBI’s Miami Field Office and the top investigator in this matter, stressed during Thursday’s press conference that the investigation is on-going and will go where it leads. It’s possible other retired players who qualify for the plan could be charged. Whether that happens might depend on what is told to prosecutors as part of plea deals.

Law-abiding retired NFL players and their families should be concerned

It’s important to not paint retired NFL players with a broad brush. There are more than 20,000 retired NFL players, many of whom qualify for the reimbursement plan and many of whom have family members who are also covered. A fraction of one percent of retired players engaging in wrongful acts should not raise questions about the other 99%. Many retired NFL players have significant health care needs—it’s been said every retired NFL player has a preexisting condition—and lawfully rely on health care benefits. They are the real victims of fraud.

Benczkowski alluded to that point when warning that the reimbursement plan’s tax-exempt status is endangered by fraudulent activity. The accused players have “threatened the ability of law-abiding former players to continue to receive tax-free reimbursements for legitimate medical expenses for themselves or their families.” To that point, the Internal Revenue Service could review whether the plan remains compliant under federal law governing health plans and tax-exempt reimbursements.

If the plan lost its tax-exempt status, thousands of retired players would lose an important benefit that the NFLPA negotiated through collective bargaining. Players would then need to pay taxes on reimbursed funds on legitimate medical expenses for themselves or their families.

New on Sports Illustrated: Napoli Fires Manager Carlo Ancelotti Despite Champions League Advancement


Ancelotti led Napoli to a win over Genk in the Champions League on Tuesday.

Napoli fired manager Carlo Ancelotti on Tuesday just hours after he led the club to a Champions League victory over Genk. 

Tuesday snapped a nine-match winless streak for Napoli, and the victory vaulted the club to the Round of 16 with a second-place finish in Group E.

“Napoli has decided to revoke the role of technical manager of the first team from Mr. Carlo Ancelotti,” Napoli said in a statement on Tuesday. “The relations of friendship, esteem and mutual respect between the company, its president Aurelio De Laurentiis and Carlo Ancelotti remain intact.”

Napoli has struggled in Serie A in 2019-20. Ancelotti's former squad has lost four of its 15 matches, entering Saturday's matchup with Parma tied for seventh place with 21 points.  

Ancelotti was in his second season with Napoli before Tuesday's decision. He began his managerial career with Serie B squad in Reggiana in 1995, and he previously managed Juventus, Chelsea, PSG and Real Madrid before joining Napoli.

The 60-year-old manager is one of three managers to win the Champions League three times.
